General The use of the Castel Winery website is subject to reading these terms and agreeing to its provisions. Castel Winery invites you to carefully read these terms. We are available for any questions or clarifications you may need.
The terms in this document and throughout the site apply equally to all genders, and the use of masculine language is for convenience only.

The Castel Winery website (hereinafter – the website) is an internet site that operates a virtual store and offers customers information and wine sales (hereinafter – the services). The site is operated by Castel Winery Ltd., registration number 512490186.
Any user and/or person performing and/or interested in performing any action on the site (hereinafter: “Purchaser”) declares and undertakes that they have read the terms, are aware of and agree to its provisions, and that they will have no claim and/or demand and/or lawsuit, directly or indirectly, against the company and/or its owners and/or the site and/or its operators and/or anyone on their behalf.

The company and the site reserve the right to change the terms from time to time, at their sole discretion, without the need for prior notice. The purchaser will have no claims and/or demands against the company and/or the site and/or anyone on their behalf due to such changes. The date of the change will be the date the updated terms are first published on the website, and any action performed on the site after that will be subject to the updated terms.

In any case of contradiction and/or ambiguity between the provisions of these terms and the content displayed on the site, the provisions of the terms will prevail. In addition, in any case of contradiction and/or ambiguity within the provisions of these terms themselves, the company will decide how to act and which provision is preferable or overriding.

It is clarified that the purchase of alcoholic beverages is only permitted to purchasers over the age of 18.

Warning: Some products contain alcohol – excessive drinking is not recommended. Excessive consumption of alcohol endangers life and harms health.

Terms of Use – Purchasing Services and Receiving Information Any Israeli resident aged 18 and over, who is not legally incapacitated, and holds a valid credit card from one of the following companies (Visa, MasterCard, Isracard, Diners, American Express), and whose transaction is approved by the credit card company, may perform actions on the site.

A purchaser’s order for wine purchase and delivery will be accepted provided all the following conditions are met:

1. The company’s confirmation is sent to the purchaser’s email that the order has been received, processed, and will be sent to the address provided in the order form.
2. The transaction is approved by the credit card company.
3. The ordered wines are in stock.
4. The address for wine delivery is within the defined delivery areas.
5. The purchaser is an Israeli resident over 18 years old, not legally incapacitated, and presents a valid ID at the time of delivery.

When placing an order, the purchaser will be required to provide the following details:
ID number, first and last name, date of birth, phone number, address, email, and payment method.

Service Policy, Prices, and Order Execution The website offers items for sale accompanied by images. These images are for illustration purposes only. Each item is presented with its price in NIS. Users can add items to the shopping cart after reviewing them and their prices. Users can modify quantities, add or remove items from the cart at any time. At the end of the order, users should proceed to checkout for approval.

If an order is placed for products displayed on the website and it turns out that one of the products is out of stock, we commit to notify the customer by phone about any shortage and arrange the shipment of the missing item or charge only for the items that will be supplied according to the customer’s preference.

Payment for Services Payment is made via credit cards. There is an option for installment payments (up to 3 installments subject to credit card company approval) without interest. Credit card details are transmitted via a secure server and are encrypted.

Customer Details and Website Security Castel Winery’s website is secured with advanced technology for content security. The details entered into the system are kept confidential using advanced security and encryption methods. Data transfer from the purchaser’s personal computer to Castel Winery’s computers is encrypted via SSL protocol.

When ordering wines advertised on the site, the purchaser will be required to enter details such as personal information, order details, credit card information, etc. (hereinafter: “Information”). The company and the site and/or its operators and/or anyone on their behalf will not be responsible for any error made by the purchaser when entering the details. They will also not be responsible, directly or indirectly, for any issue where purchase details are not recorded in the system and/or for any technical or other problem that prevents the execution of actions on the site or performs them incorrectly.
By making a purchase on the site, the purchaser consents that their personal details (such as name, ID number, email address, etc.) will be stored in the company’s databases, in accordance with legal provisions.

Transaction details on the site, including order and purchaser details, will be transmitted via an encrypted security protocol (SSL) commonly used in e-commerce. These details will not be transferred by the company and the site operators to external parties, except to the payment and credit card companies, to complete the purchase transaction made by the purchaser and subject to legal provisions. The company will not use the purchaser’s payment details except to process payment for the transaction, and these details will not be transferred to any other party except for this purpose, unless required by law.
The company will not transfer the purchaser’s personal details to any external party, except if required by an authorized governmental authority or by court order, in accordance with legal provisions.

Despite the above, the company may transfer the purchaser’s personal details to a third party in cases where: the purchaser has committed an act or omission that harms and/or may harm the company and/or any third party, the purchaser used the company’s services to perform an illegal act, the company received a court order to provide the purchaser’s details to a third party, in any legal disputes or proceedings, etc.

By making a purchase on the site, the purchaser declares that they are aware that providing false details is a criminal offense and that those who provide false details may face legal action, including tort claims for damages that may be caused to the site and/or its owners and/or its operators and/or anyone on their behalf.

The company may use the purchaser’s personal details, without identifying the specific purchaser, for statistical analysis and present or provide it to others without needing the purchaser’s consent.

The purchaser acknowledges that since transactions are conducted in an online environment, the company cannot guarantee absolute immunity from unauthorized access to its computers or the exposure of stored information. If a third party succeeds in accessing the information stored by the company and/or misuses it, the purchaser will have no claims and/or demands against the company and/or anyone on its behalf due to this.
The company may use “cookies” to provide the purchaser with quick and efficient service and save the purchaser from having to enter their personal details every time they visit the site.

By providing their details on the site (through contact mechanisms and forms, event registration, receiving newsletters, or purchasing products), the purchaser agrees to receive updates via email, text messages (SMS), or any other means, including content updates, newsletters, information about services and products, promotions, website innovations, and advertisements, as defined in section 30A of the Communications Law (Telecommunications and Broadcasting), 1982. At any time, the purchaser may withdraw their consent and notify the company of their refusal to receive advertisements, generally or specifically, by sending a refusal notice. The method of sending the refusal notice will be detailed in the advertisements sent to you by the company and/or its representatives.

Product Returns Since wine may spoil under uncontrolled conditions and we cannot control how returned wine was stored, we regret that we cannot accept returned wine bottles.
In cases of delivery delays, the customer may cancel the transaction without cancellation fees.

Cancellation Policy:

The cancellation policy and product return are subject to the Consumer Protection Regulations (Cancellation of Transaction), 2010, and the Consumer Protection Law, 1981.
It is possible to cancel a service that has been set for a customer at any time, provided that the customer informs the site management of the cancellation or change of the date at least 30 days before the end of the engagement.
Order cancellation will be possible up to 24 hours from the order date, provided the order has not been dispatched.
In case of service cancellation, the customer will not be charged for the service.
No refunds will be given for services that have been performed.
The site reserves the right to cancel the delivery of an order to the user with at least two hours’ notice. In such a case, the user will have no claims against the site.
Notice of cancellation or cessation by the company will be given to the user, and the company will refrain from charging the user’s credit card or refund any amount paid for the products, if paid.

Ownership and Preservation of Rights The site contains various materials protected by copyright, trademarks, and other intellectual property rights, including content, images, graphics, music, video, and sound, some owned by the company and some by third parties. Users and/or third parties performing actions on it are not allowed to modify, publish, transmit, or transfer, participate in the transfer or sale, create derivative works from, or exploit the site or any part of it for any purpose other than its intended purpose.

The company permits the user to “download” data to their personal computer for personal use only, which is not commercial. This permission, as well as any other lawful action on the site, does not grant the user any proprietary right in the said information or the site’s content as a whole.

Any delay by the winery in exercising a right it is entitled to or not insisting on a right it is entitled to under these terms or the law will not be considered a waiver of such right.

Limitation of Liability The site takes all measures to ensure the information displayed on it is reliable. In cases where errors are found in the displayed information, the site will take all measures to resolve the issue and will allow the cancellation of the transaction without cancellation fees.

The images on the site are for illustration purposes only. It should be emphasized that there may be differences and changes between the appearance of the product in the image and the actual product. Each product has a detailed description, and the bottle’s exact volume is indicated. Any difference between the stated volume and the image is for illustration purposes only. The image does not indicate the bottle’s volume. Wine vintages may change depending on stock and availability, and prices may change accordingly.
The company’s liability, under any legal grounds, for products mentioned in this section will not exceed the actual amount paid for the product/service ordered by the purchaser.
The store and/or the site’s owners and/or its founders and/or any of its operators and/or any of its managers and/or anyone on their behalf are not responsible for the server through which the site operates being free of viruses or other harmful elements that may damage or impair the purchaser’s personal computer or other equipment when accessing and/or ordering or using services and/or using the site, subject to all security measures being taken by the site.

Additionally, the store will not be held responsible for any illegal activity on the site carried out by any purchaser or third party not under the company’s control.
The company reserves the right to terminate or prevent purchasers’ access to any part of the site or the entire site at any stage.

Indemnity and Compensation for Misuse of the Site Anyone who misuses the site agrees to indemnify and compensate the company and/or the site’s owners and/or its founders and/or any of its operators and/or any of its managers and/or anyone on their behalf for any claims and/or expenses and/or damages of any kind, including legal expenses, incurred by the company and/or the site’s owners and/or its founders and/or any of its operators and/or any of its managers and/or anyone on their behalf.

Shipping and Delivery Times Shipping Fees: Purchasing on the site is possible with an order of at least 6 bottles of wine, without shipping fees. The purchaser on the site will be charged shipping fees depending on the type and location of the delivery. The company reserves the right to charge the purchaser shipping fees at its sole discretion, without prior notice.

Delivery Areas and Times:
Unless otherwise determined by the company, these are the delivery areas and times: Gush Dan, Sharon, Jerusalem, and the surrounding area – up to 5 business days; between Be’er Sheva and Haifa – up to 7 business days;
Deliveries to other areas – up to 10 business days. Deliveries will be made from Sunday to Thursday, between 10:00 AM and 3:00 PM, in coordination with the purchaser.
Delivery times are subject to delays beyond the company’s control and to force majeure events as defined below.
Without derogating from the aforementioned, in any case where the company, at its sole discretion, believes that its services and/or product orders are being misused, the company may decide not to deliver wines to the purchaser, and the purchaser will have no claims and/or demands and/or lawsuits regarding this matter.
The shipment will be delivered to the purchaser or the recipient at the address specified by the purchaser in the order, subject to the presentation of a valid ID by the recipient and confirming they are over 18 years old.
It is possible to order products outside the State of Israel. For more details, please contact the company.

Governing Law and Jurisdiction
The interpretation and enforcement of these terms and any action or dispute arising therefrom will be conducted in accordance with Israeli law only, and the competent court in Jerusalem will have exclusive jurisdiction.
